1. Introduction
Welcome to RentFlow. By accessing or using our platform at rentflow.zidi.digital (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the platform. If you do not agree to these Terms, do not use the Service.
2. Description of Service
RentFlow is a property management platform designed for landlords and tenants in Kenya. The Service enables landlords to manage properties, create leases, track rent payments, log maintenance requests, and issue utility bills. Tenants can view their lease details, pay rent via M-Pesa, and submit maintenance requests through the platform.
3. User Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and up-to-date information during registration.
- Use the Service only for lawful purposes in compliance with Kenyan law.
- Not share your account credentials with third parties.
- Not attempt to gain unauthorized access to other users' accounts or data.
- Not use the Service to harass, defraud, or harm other users.
4. Payment Terms & M-Pesa
RentFlow facilitates rent payments through Safaricom's M-Pesa Daraja API. When a tenant initiates a payment:
- The tenant authorizes the transaction directly with Safaricom via STK Push.
- RentFlow records the payment confirmation upon receiving Safaricom's callback.
- Subscription fees for the RentFlow platform are billed separately to landlords.
- RentFlow does not hold funds on behalf of any party. All rent money is transacted directly between tenant and landlord via M-Pesa.
- Disputes regarding M-Pesa transactions must be resolved with Safaricom directly.
5. Landlord–Tenant Relationship
RentFlow is a technology platform only. We are not a party to any lease agreement between a landlord and a tenant. All lease agreements, payment obligations, and disputes arising from a tenancy are solely between the landlord and the tenant. RentFlow does not provide legal, financial, or property management advice. Landlords are responsible for ensuring their lease agreements comply with the Kenyan Landlord and Tenant (Shops, Hotels and Catering Establishments) Act and the Rent Restriction Act where applicable.
6. Intellectual Property
All content, software, trademarks, and intellectual property on the platform remain the property of RentFlow and its licensors. You may not copy, reproduce, or distribute any part of the Service without our written permission. You retain ownership of any data you upload to the Service.
7. Limitation of Liability
To the maximum extent permitted by Kenyan law, RentFlow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Maintenance windows, third-party outages (including Safaricom M-Pesa), and unforeseen events may cause temporary unavailability. We will endeavour to provide advance notice of scheduled downtime.
9. Termination
You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service. Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days after termination before deletion, unless required by law to retain it longer.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through an in-app notification. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
